JUDGMENT / ORDER

This criminal original petition has been filed praying to modify the bail conditions imposed by the Learned Special Judge, Special Court under TNPID Act Cases, Coimbatore in Crl.M.P.No.1154 of 2017 in Crime No.7 of 2016 pending investigation on the file of The Inspector of Police, Economic Offences wing-II, Coimbatore.

While granting bail, the learned Special Judge, Special Court under TNPID Act Cases, Coimbatore imposed the conditions on the petitioner that the petitioner/A-16 shall deposit a cash security of Rs.10 lakhs (Rupees ten lakhs only) into the Court with two sureties for a likesum; the two sureties must be blood relatives of the petitioner/accused; the petitioner shall report before the EOW-II, Coimbatore Police daily at 10.30 a.m., until further orders and the petitioner should not temper the witnesses and shall co-operate with the investigation.

The learned counsel for the petitioner would submit that one of the conditions imposed by the trial Court that the petitioner/A-16 shall deposit a cash security of Rs.10 lakhs (Rupees ten lakhs only) into the Court with two sureties for a likesum and since the petitioner is not in a position to deposit the cash security of Rs.10 lakhs, he could not able to come out from the Prison. Hence, he prays for modification of the condition imposed by the trial Court.
4. Heard the learned Government Advocate (crl.side) for the respondent.

In the stated circumstances, one of the conditions imposed in the bail order dated 07.04.2017 passed in Crl.M.P.No.1154 of 2017 by the learned Special Judge, Special Court under TNPID Act Cases, Coimbatore that, the petitioner/A- 16 shall deposit a cash security of Rs.10 lakhs (Rupees ten lakhs only) into the Court with two sureties for a likesum is modified to the effect that, the petitioner shall deposit a cash security of Rs.1,00,000/-(Rupees one lakh only) with two sufficient sureties for like sum each. Execept the above said modification, the other conditions remain unaltered.
6. Accordingly, the criminal original petition is disposed of.
