Order:
This Writ Petition is filed with the grievance that respondent No.3 has issued the notice bearing No.MIG/24/PH-II/D.Reddy/KKP/2014-15, dated 09- 05-2014, to the petitioner to vacate plot No.MIG 24, Dharma Reddy Colony, Phase-II, Hydernagar Village, Balanagar Mandal, within seven days failing which the same will be intimated to respondent No.4 for taking necessary action under Sections 52 and 53 of the A.P.Housing Board Act, 1956.
At the hearing, Mr.Kasi Nageswara Rao, learned Counsel for the petitioner, submitted that the issue relating to the petitioner’s eviction is pending before respondent No.4; that since 05-11- 2013, the case was adjourned on five occasions; and that respondent No.4 has not been disposing of the same. He has further submitted that a Board has been erected by respondent No.3 unlawfully in the subject plot, even while the eviction proceedings are pending before respondent No.4.
No one entered appearance for respondent Nos.2 to 4. However, considering the fact that the eviction proceedings are stated to be pending before respondent No.4, the said respondent is directed to complete the enquiry and pass an appropriate order within two months from the date of receipt of this order. It is made clear that the alleged planting of board by respondent No.3 in the subject plot shall be subject to the result of the enquiry and passing of final order by respondent No.4.
Subject to the above direction, the Writ Petition is disposed of.
As a sequel to disposal of the Writ Petition, WPMP.No.48916 of 2014, filed by the petitioner for interim relief, is disposed of as infructuous.
