HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.25395 of 2014 ORDER:
Several extents of land were acquired for the purpose of construction of Terminal Balancing Reservoir for supply of water to twin cities. Land of the petitioners to an extent of 133.5 square yards in Plot No.187 in Survey No.59, situated at Karmanghat Village, Saroor Nagar Mandal, Ranga Reddy District, was also acquired. The compensation was determined and the same was received by the petitioners. Some of the persons, whose lands were acquired, filed an application under Section 18 of the Land Acquisition Act, 1894 (for short, ‘the Act’) for enhancement of the compensation determined. The matter was referred to civil Court and after enquiry in the reference case O.P.No.94 of 1999, the Principal Senior Civil Judge, Ranga Reddy District, passed an award by judgment, dated 19.06.2013, enhancing the value of the land from Rs.150/- per square yard to Rs.300/- per square yard.
2. After the enhancement of compensation was ordered in O.P.No.94 of 1999, the petitioners filed application under Section 28-A of the Act on 04.09.2013 requesting to grant similar enhancement.
3. The grievance of the petitioners necessitating institution of this writ petition is that even though such a representation was made on 04.09.2013, so far, no orders are passed.
4. Having regard to the submissions made and without expressing any opinion on merits, the Writ Petition is disposed of directing the District Collector, Ranga Reddy District (2nd respondent) to consider the application filed by the petitioners under Section 28-A of the Act on 04.09.2013 and pass appropriate orders, as warranted by law, within a period of six (6) weeks from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
