JUDGMENT / ORDER

The petitioner is aggrieved with Ext.P5 notice under Section 66 of the Kerala Co-operative Societies Act, 1969 (for brevity, 'the KCS Act'). Obviously, the same has been issued without noticing the name of the officer, who is entrusted with the enquiry. The same is illegal by virtue of the provisions of Section 66 of the KCS Act. In such circumstance, the learned Government Pleader also submits on instruction that the illegality has been noticed by the department and the same would be recalled and fresh order issued, if found necessary. In such circumstance, the writ petition would stand disposed of recording the submission of the department and leaving liberty to the department to take appropriate steps.
