Since 11 years, no steps have been taken despite the order of this Court dated 28.03.2008. The matter was earlier listed on 08.11.2014, despite that no steps have been taken by the Uttranchal Road Transport Corporation who has filed this appeal which is belated by 363 days.
The award is of the year 2003, it submitted that because of the bifurcation, there is delay. The delay has not been properly explained which is of approximate one year.
Now in the year 2019, the two claimants must have already filed an execution petition also.
Be that as it may, the amount was ordered to be paid jointly and severely back to respondent nos. 1, 2 and 3.
I do not find any reason to condone the delay after a period of practically 14 years and awakening the claimants after 14 years.
Hence the application is dismissed.
(Order on appeal.) The application, seeking condonation of delay in filing the appeal, having been dismissed vide order of date, this appeal being barred by limitation, is also dismissed.
