JUDGMENT / ORDER

Hon'ble Om Prakash-VII,J.
Learned counsel for the appellant submitted that Smt. Anita Nayar has suffered injuries in an accident held on 11.11.2011 and she died after two years in the year 2013. The claim petition was filed for claiming the compensation for the expenses incurred in the treatment of the injuries. The death of Smt. Anita Nayar has no correlation with the accident, therefore, the award of compensation on the basis of death is wholly unjustified.
We find substance in the argument of learned counsel for the appellant, which requires consideration.
Admit.
Issue notice. The appellant may take steps to serve the respondents by registered post.
Until further orders, the effect and operation of the impugned judgment and order/award dated 25.3.2014 passed by the Motor Accident Claims Tribunal, Court No. 2, Meerut, in Motor Accident Claim Petition No. 1303 of 2011 (Smt. Anita Nayar, since deceased, now represented by Aditya Nayar and others Vs. Uttarakhand State Road Transport Corporation) shall remain stayed provided the appellant deposits 50% of the amount of compensation within a period of four weeks and the same shall be deposited in a fixed deposit scheme in a nationalized bank, yielding maximum interest. Any amount already deposited shall be given adjustment.
Office is directed to remit back the statutory amount to the concerned Tribunal within four weeks.
