1.0 This application has been preferred by the applicant seeking permission to retire opponent No.1- petitioner from the services on reaching the age of superannuation subject to and without its prejudice to effect dismissal order which is passed prior in point of time of his superannuation.

2.0 In view of the fact the respondent No.1- petitioner has attained the age of superannuation and he has retired, permission as sought for is granted and this application this application is allowed accordingly.
