Both parties have arrived at a compromise. With consent of Shri U.S.Singh Visen, learned counsel for the petitioner-Employer, Shri Nitinjay Pandey, learned counsel for the respondent-Workman and the learned Standing Counsel for the State-respondent, the following order is being passed:
I. The petitioner-employer shall award a sum of Rs. 2 lakhs to the respondent-workman as compensation in lieu of back wages and other amounts awarded to the workman by the labour court. The sum of Rs. 2 lakhs is towards the full and final satisfaction of all the claims of the respondent workman against the petitioner- corporation.
2. The payment shall be made within a period of two months from today.
3. The respondent workman upon receipt of the aforesaid a sum of Rs. 2 lakhs shall not press the amount awarded to the respondent workman by the labour court as backwages, interest etc.
4. The respondent workman shall be reinstated as a driver on or before 12.01.2023.
5. The respondent workman shall produce a fresh driving license or the certificate of renewal of the earlier driving license available with him.
6. The Transport authorities are directed to process the application for fresh driving license/renewal of the earlier driving license made by the respondent workman within a period of three months from the date of receipt of the said application.
7. The respondent workman shall not be entitled to salary from the date of the labour court award till 12.01.2023 or till the date when the respondent workman submits the driving license.
Shri U.S.Singh Visen, learned counsel for the petitioner-Employer, Shri Nitinjay Pandey, learned counsel for the respondent-Workman and the learned Standing Counsel for the State-respondent shall fix their signatures to the ordersheet in regard to the above said terms of mutual agreement between the parties.
The writ petition is disposed of in terms of the above compromise.
