Sri U.S. Singh Visen, learned counsel for the petitioner submits that the proceedings under Section 33 (C) 2 of the U.P. Industrial Dispute Act, 1947 were not maintainable before the learned labour court. The employees provident fund has already been disbursed to the respondent workman by the competent authority under the Employees Provident Fund Act.
Matter needs consideration.
Sri Prabhakar Pal, learned counsel holding brief of Sri Rajesh Kumar Singh, learned counsel for the respondents is present.
The respondents to file counter affidavit within four weeks. List thereafter.
Till the next date of listing the effect and operation of the impugned order dated 13.09.2019 shall remain stayed.
