Heard Sri R.S. Singh, learned counsel for the petitioner, learned Standing Counsel for the respondents no. 1,2 and 4 and Sri Ram Gopal Tripathi, learned counsel for the respondent no.3.
The petitioner is a cooperative society and is assailing the order dated 25.9.2018 whereby certain adjustments towards commission is sought to be made for the year 2007-08, 2008- 09, 2009-10 and 2010-11. In respect of his grievance in para 18 of the writ petition, it is stated that the petitioner has preferred a representation on 2.1.2018 before the Commissioner/Registrar, Cooperative Society, Lucknow but the same has not been decided. Copy of the representation has not been filed with the writ petition.
We, however, dispose of this writ petition with a direction that if the petitioners prefer a fresh representation in respect of their grievance as raised in the present petition before the Respondent no.2-Commissioner/Registrar, Co-operative, U.P. Lucknow within 15 days from today along with a certified copy of this order, the Respondent no.2 shall consider and decide the same in accordance with law within a further period of three months.
It is made clear that the Court has not adjudicated the claim of the petitioner on merit.
