Learned Addl. Chief Standing Counsel states that special appeal is under consideration.

Learned counsel for the petitioner states that even the delay has not been condoned and the opposite parties are duty bound to comply the order passed by this Court. He further states that the Laboratory technician posted in the ESI have been part and partial of the Health department.

Considering the aforesaid facts , the opposite parties are directed either to obtain an interim order in the appeal or comply the judgment of this Court.
