Heard Sri Ravi Kant, learned Senior Counsel assisted by Sri Raj Mohan Saggi, learned counsel for the petitioners.
The petitioner no. 1 is an association of the employees of the Jal Kal Department of Varanasi, Allahabad, Kanpur, Lucknow and Agra and petitioner no. 2 alleged to be its President. They have jointly preferred this petition for directing the State Government to provide salary, gratuity and other dues to the employees of all the aforesaid five Jal Kal Departments which have merged with the respective Nagar Nigams.
The submission of the learned counsel for the petitioner is that the services of the aforesaid Jal Kal Departments stood merged with the respective Nagar Nigams and therefore, on retirement they are entitled to same benefits as are admissible to the employees of the Nagar Nigams.
The petitioners in this regard have submitted a representation dated 06.07.2017 to the Principal Secretary, State of U.P., Nagar Vikas, Lucknow-respondent no. 1. It is said that till date no decision or action has been taken on the aforesaid representation.
In view of the facts and circumstances, as there is no order refusing the employees of the Jal Kal Departments the financial benefits, they are asking for, we deem it appropriate that let a order be passed in this regard by the Principal Secretary- respondent no. 1 on the aforesaid representation of the petitioner in accordance with law, most expeditiously, if possible within a period of three months so that the reason for not extending the above benefits may come on record.
