HONOURABLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No. 39533 of 2014 ORDER:
Petitioner is borrower and on account of non payment of loan amount, the account of petitioner became non-paying asset and appropriate steps were initiated by the bank to recover the due amount. Earlier petitioner filed W.P. No. 34259 of 2014 challenging the action of the respondent bank in conducting auction of the property. Division Bench of this Court by order dated 13.11.2014 disposed of the writ petition granting liberty to the petitioner to pay 50 % of the outstanding loan amount due to the bank within five weeks from the date of receipt of copy of the order and to pay remaining amount within five weeks thereafter. The Division Bench permitted the auction to go on but should not be confirmed. If the petitioner industry fails to fulfil any one of the said conditions, sale can be confirmed and sale certificate shall be issued to the auction purchaser.
This writ petition is filed by the very same petitioner contending that in order to comply with the directions of this Court, petitioner should be informed of the outstanding amount and in spite of several representations submitted, bank has not furnished the statement of account, unless petitioner is aware of the outstanding payable by him, he cannot effectively comply with the directions issued by Division Bench of this Court.
Today learned standing counsel for respondent bank produced statement of account of the petitioner. Copy of the same was furnished to the learned counsel appearing for the petitioner. In view of the same, the cause in the writ petition does not survive.
Accordingly, the writ petition is dismissed as infructuous. No costs.
