Heard Sri A.C.Srivastava, learned counsel for the applicant, Sri G.P.Singh, learned counsel for the complainant and learned A.G.A. for the State and perused the record.
It has been contended by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case. He further submits that two bank accounts were opened by the Anand Engineering College, Keetham Agra and it is stated that out of said two accounts, one account was opened by the applicant separately in the name of the College and an amount of Rs.1 Crore & 10 lacs was deposited in the said bank account which is stated to be opened by the applicant, out of which Rs.2958519 has been transferred in his personal account, the said allegation is absolutely false one and the applicant being an employee of the College in question has been misused in the present case by the other co-accused persons.
Learned earned A.G.A. vehemently opposed the prayer for anticipatory bail and submitted that there appears to be fraud committed by the applicant and the amount which was transferred is a huge amount.
Without expressing any opinion on the merits of the case and considering the submission advanced, the nature and gravity of the accusation, I find no good ground for grant of bail to the applicant-Uttam Bansal involved in Case Crime No.85 of 2019, under Sections 420, 467, 468, 471 I.P.C., Police Station Sikandara, District Agra.
Accordingly, the anticipatory bail application is rejected.
The applicant is at liberty to move bail application under Section 439 Cr.P.C., if so advised.
