This Petition has been filed by the petitioners seeking to punish the respondent for his act of wilful disobedience of the order passed by this Hon'ble Court made in Crl. OP.No.6550 of 2015, dated 27.04.2015.
2.The petitioners were arrayed as accused in Crime No.112 of 2011 and after completing the investigation, the respondent police filed a charge sheet which is now pending trial in S.C.22 of 2015 before the learned Principal Sessions Judge, Villupuram.
3. The petitioners filed Crl. O.P. No.6550 of 2015 for quashing the proceedings in S.C. No.22 of 2015 on the ground the complaint given by the petitioners in Crime No.113 of 2011 was registered by the respondent/police and that the police have not taken any action in that case.
4. This court dismissed the Crl.O.P.No.655 of 2015 on 27.04.2015 with the following observation: In the result, this petition is devoid of merits and the same dismissed with a further direction to the respondent police to complete the investigation in Cr. No.113 of 2011 and act in accordance with law. Consequently, connected miscellaneous petitions are closed.
5. Therefore, the petitioners have filed the present contempt petition alleging that the police have not completed the investigation in Crime NO.113 of 2011.
6.Today, the learned Additional Public Prosecutor, on instructions, submitted that the order dated 27.04.2015 passed by this court in Crl. O.P.No. 6550 of 2015 has been complied with, in asmuchas the respondent police have completed the investigation in crime No.113 of 2011 and they have filed charge sheet before Judicial Magistrate, Thirukovilur, on 31.07.2017 for offences Under
sections 147,148,323,324,325 and
427 of I.P.C. and Section 4 of Woman Harassment Act. against five accused. However, the learned Judicial Magistrate, Thirukovilur, has not taken the same on file, since, the original FIR is available in the Special Court for S.C./S.T. Cases, Villupuram.
Recording the said submission made by the learned Additional Public Prosecutor, this contempt petition is closed.
