Heard Sri Pankaj Bharti, learned counsel for the applicant, Sri S.N. Mishra, learned counsel for the complainant and learned A.G.A. for the State and perused the record.
It has been contended by the learned counsel for the applicant that cylinders in question do not belong to the applicant. He has been falsely implicated in the present case.
Learned A.G.A. has vehemently opposed the prayer for bail and submitted that 36 cylinders were recovered from the premises of the applicant.
Without expressing any opinion on the merits of the case and considering the submission advanced, the nature and gravity of the accusation and the fact that 36 cylinders were recovered from the premises of the applicant, I find no good ground for grant of bail to the applicant Usman involved in Case Crime No. 291 of 2019 under sections 3/7 E.C. Act, police station Jhinjhana, district Shamli.
Accordingly, the anticipatory bail application is rejected.
However, the applicant will be at liberty to move regular bail application under section 439 Cr.P.C., if so advised.
