Sri S.P.Singh, Advocate, has filed counter affidavit along with his Vakalatnama on behalf of respondent no.3 today in Court, which is taken on record.
Heard Sri Balram Mishra, learned counsel for the petitioners, Sri S.P.Singh, learned counsel for respondent no.3, Sri Deepak Mishra, learned A.G.A. for the State and perused the impugned FIR as well as material brought on record.
This petition has been filed by the petitioners with a prayer to quash the FIR dated 15.7.2018, registered as case crime No.131 of 2018, under Sections 307, 506 I.P.C., P.S. Walterganj, District Basti.
Learned counsel for the petitioners submits that the petitioners and respondent no.3 have entered into a compromise, hence, FIR be quashed by this Court in view of said compromise.
Learned counsel for respondent no.3 admitted the fact of compromise.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioners shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but they shall co-operate with the investigation of the case.
The S.P., Basti shall ensure compliance of this order.
With the above direction, this petition is finally disposed of.
