Heard Ms. Haya Rizvi, learned counsel for the applicant, learned A.G.A for the State and perused the record.
By means of this application, the applicant, who is involved in Case Crime No. 114 of 2021, under Section 376, 354(kha) I.P.C. and Section 3/4 POCSO Act, Police Station-Purkaji, District-Muzaffarnagar, is seeking enlargement on bail during the trial.
The age of the victim is 13 years as per medico legal report. However, the age of the applicant is almost 35 to 40 years. The applicant is the maternal uncle (Mama) of the victim. Initially the applicant misbehaved with the girl and, thereafter, ravished her.
Looking to the age of the victim, I am not inclined to enlarge the applicant on bail. This bail application is rejected.
However, the learned Trial Court is directed to gear up the matter and make every necessary endeavour to conclude the trial within a period of one and half year from the date of production of a certified copy of this order.
