Heard the learned counsel for the applicant.
A writ petition preferred by the applicant was disposed of with a direction to the competent authority to decide the pending election petition expeditiously and preferably within a period of six months.
From the perusal of the order-sheet it is apparent that on numerous occasions the disposal of the election petition has been fettered on account of lawyers abstraining from work.
In view thereof and on the state of the record as it exists it cannot be said that the opposite party is in contempt.
This petition is, therefore, disposed of subject only to the observation that the opposite party shall bear in mind that an election petition must, by its very character, be decided with expedition failing which the remedy itself may be rendered nugatory. The respondent shall endeavour that the pending petition is disposed of as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
Learned counsel is permitted to file a copy of this order before the S.D.M. before whom the concerned petition is pending.
