This writ petition, inter alia, has been filed for the following reliefs:
"A. Issue a appropriate writ, order or direction in the nature of mandamus commanding and directing the respondent No. 2 and 3 direct him to restrain the respondent Nos. 4 to 11 may not make the illegal construction over the plot No. 688 measuring area 0.3040 hectare and Plot No. 702 measuring area 44.10 hectare situated in village Shivriha Tehsil Machhali Sahar District Jaunpur in compliance of interim order dated 3.6.2019 passed by Sub-Divisional Officer in Suit No. 06481 of 2018 filed by husband of the petitioner U/s 116 U.P. Revenue Code of 2006 which is pending for the final disposal before the Sub-Divisional Officer Machchali Sahar."
Heard learned counsel for the parties and perused the record.
In substance, the petitioner is seeking a relief against the private parties (Respondents Nos. 4 to 11), who are allegedly causing interference in the peaceful possession of the petitioner over the land in dispute and in this regard a civil suit is already pending before the concerned Court below.
In view of the above, we do not see any justification to interfere in the matter.
The writ petition is, accordingly, dismissed. However, it is open to the petitioner to pursue her remedy before the appropriate forum in accordance with law.
