Heard Sri Krishna Kumar Singh, learned counsel for the petitioner, Sri Mahboob Ahmad, learned counsel for respondents no. 2 and 3, Dr. D.K. Tiwari, learned Standing Counsel and have perused the record.
By means of this petition under Article 226 of the Constitution, the petitioner has raised grievance of non- consideration of her application for shifting of the line for the purposes of her convenience.
In our considered opinion, when a consumer approaches the licensee for the purposes of any correction or amendment in the electricity connection including the supply line, it is the duty cast under the Supply Act, 2005 upon the authority to look into the grievance and pass order either way.
In such circumstances the writ petition is disposed of with a direction that the grievance of the petitioner, as raised in her application dated 3rd of June, 2019, shall be looked into by the concerned Executive Engineer who shall pass a reasoned and speaking order within four weeks from the date of production of a certified copy of the order.
