Heard learned counsel for the petitioner and learned Standing Counsel. Nobody has put in appearance on behalf of Goan Sabha even in the revised calls.
By means of this petition under Article 226 of the Constitution the petitioner prays that she may be permitted to continue with the lease granted in favour of her deceased husband Ram Laut who has died during the pendency of the lease.
It is submitted by the learned counsel for the petitioner that the petitioner has moved an application in this regard before the Sub-Divisional Magistrate concerned on 21.5.2019 which has been brought on record as annexure-3 to the writ petition.
Without going into the merits of the claim set up by the petitioner the writ petition, at this stage, is disposed of with a direction to the Sub-Divisional Magistrate concerned, namely the respondent no. 2 to decide the pending application of the petitioner dated 21.5.2019 in accordance with law after giving full opportunity of hearing to the petitioner , within a period of three months from the date of production of certified copy of this order.
It is made clear that the petitioner is at liberty to file all the relevant documents and may take legal pleas as may be available, if any, in her favour to succeed the lease, before the learned Magistrate.
