Heard learned counsel for the petitioner and perused the record.
The present petition has been filed for direction upon the court of Civil Judge (Jr. Div.), City Jaunpur to decide Original Suit No.489 of 2000 (Urmila Devi Vs. Murali and others) within stipulated period.
From the order-sheet of the case it appears that on number of occasions the matter had to be adjourned either on absence of the Presiding Officer or lawyers strike.
Under the circumstances, this Court finds no good reason to issue any specific direction. However, it is observed that if the court where the proceedings are pending is lying vacant since long, then it shall be open to the petitioner to apply to the District Judge concerned for transfer of the proceeding to another court of competent jurisdiction, which may be available. In case the court where the proceedings are pending is available, then it shall be open to the petitioner to move expedite application before the court concerned.
With the aforesaid liberty, the petition is disposed off. Order Date :- 24.4.2018.
