Following orders were passed in the matter on 28.08.2018:-
"Grievance is that despite an order passed by this Court in Writ Petition No. 56142 of 2017 as well as consequential order passed by the Chief Medical Officer, Auraiyya on 27.1.2018, all retiral dues payable to the petitioner has not been released so far. Submission is that GPF, benefits of arrears due to introduction of 7th Pay Commission as well as ACP have still not been paid to him.
Learned Standing Counsel may obtain instructions in the matter. Put up in the additional cause list on 7.9.2018"
Learned counsel for the petitioner submits that 90% amount of GPF has been credited to the account of the petitioner, but other amount has not been paid.
Learned standing counsel states that balance 10% GPF has also been sanctioned and shall be released after obtaining approval from the Accountant General's Office. It is also stated that other amount, which is found due and payable to the petitioner, shall be worked out and released within a period of thee months.
In view of the stand taken by the respondents, this petition stands disposed of with a direction upon respondents to examine the petitioner's grievance and to release the amount of terminal benefit, which is found due and payable to the petitioner, within a period of three months from the date of presentation of a certified copy of this order.
In case the retiral dues are not released, in terms of the aforesaid direction, petitioner shall be entitled to get interest @ 8% per annum. It shall be open for the authorities to recover the amount of interest, after determining the guilt of the officer concerned, who is responsible for not ensuring the release of such amount.
