JUDGMENT / ORDER

[Order of the Court was made by K.K.SASIDHARAN, J.] The petitioner has filed this writ petition to direct the respondents 1 to 3 to remove the encroachment said to have been made by the respondents 4 to 6 in a public property.
2.Even according to the petitioner, the land in question is a kanmoi. It is for the authority to take action for removal of encroachment in respect of the kanmoi belonging to the Public Works Department. The competent authority is not a party to the writ petition. We, therefore, do not find any reason to issue a writ of mandamus.
3.We permit the petitioner to give a comprehensive representation to the Jurisdictional Engineer. In case, any such representation is given, the same shall be considered and disposed of by the Jurisdictional Engineer, after issuing notice to the respondents 4 to 6 and other encroachers, if any, as expeditiously as possible.
4.The writ petition is disposed of with the above direction. No costs.
