ORDER:
The writ petition is filed alleging inaction on the part of the respondents 2 and 3 in conducting survey, as sought for by the petitioner, with respect to land in an extent of Ac.1.81 cents in R.S.No.90/1P situated in Vaivaka Village, Mudinepalli Mandal, Krishna District.
2. Learned Assistant Government Pleader, on instructions, submits that the steps for conducting survey were initiated but the survey could not be conducted, as there appears to be a fish tank on the land and it is stated that as soon as the tank dries up, further, action will be taken and the survey will be conducted. Learned Assistant Government Pleader, therefore, requests time for conducting survey.
3. In view of the above, respondents 2 and 3 are directed to take up the work relating to survey, as sought for by the petitioner, after notice to the fourth respondent and any other affected neighbouring cultivators and complete the said exercise and furnish report to the parties within a period of three (3) months from the date of receipt of a copy of this order.
The writ petition is accordingly disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
