The Court made the following:
ORDER:
This civil revision petition is filed against order, dated 18.12.2013, in I.A.No.521 of 2013, in I.A.No.1588 of 2008, in O.S.No.473 of 2008, on the file of the learned Principal Junior Civil Judge, Ongole, whereby the application filed by the petitioner for impleading respondent No.4 as respondent No.4 in I.A.No.1588 of 2008 has been dismissed.
At the hearing, Sri I.Koti Reddy, learned counsel for the petitioner, upon realising that the very suit filed by his client questioning preliminary decree itself is not maintainable, requested for permission to withdraw the civil revision petition with liberty to his client to take appropriate steps either for restoration of the earlier suit or filing appeal questioning the preliminary decree.
The civil revision petition is accordingly dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.
As a sequel to dismissal of the civil revision petition, C.R.P.M.P.No.2139 of 2014 shall stand disposed of as infructuous.
