HONOURABLE SRI JUSTICE S.RAVI KUMAR TRANSFER C.M.P.No.229 of 2014 ORDER:
This petition is filed to withdraw O.P.No.76 of 2013 from Senior Civil Judge, Tadepalligudem, West Godavari District and transfer the same to Senior Civl Judge, Gudiwada, Krishna District, for disposal in accordance with law.
Petitioner is wife and she filed her affidavit in support of the petition. According to her affidavit, on the basis of her complaint, C.C.was registered and the same is pending before Additional Judicial First Class Magistrate, Gudiwada, Krishna District and she also filed D.V.C.No.14 of 2013 and also M.C.No.30 of 2012 and all these cases are pending before the Judicial First Class Magistrate, Gudiwada, Krishna District and respondent-husband is attending in the said cases. It is stated that respondent intentionally filed O.P. for restitution of conjugal rights at Tadepalliguden to harass her and she has no male assistance to go to Tadepalligudem from Gudiwada and by taking her convenience into consideration O.P.76 of 2013 may be transferred from Senior Civil Judge, Tadepalligudem, West Godavari District to Senior Civil Judge, Gudiwada, Krishna District.
Respondent in spite of service of notice neither appeared in person nor through any advocate.
Heard arguments.
Considering the reasons stated in the affidavit and also convenience of the wife, O.P.No.76 of 2013 is withdrawn from Senior Civil Judge Court, Tadepalligudem, West Godavari and transferred to Senior Civil Judge, Gudiwada, Krishna District, for disposal according to law.
Accordingly, this Transfer C.M.P. is allowed.
As a sequel to the disposal of this Transfer C.M.P., the Miscellaneous Petitions, if any, pending, shall stand dismissed.
