Heard Sri Amar Nath Singh, learned counsel for the petitioner, learned Standing Counsel for the respondents No.1 to 3 and Sri Vivek Verma, learned counsel for the respondent No.4.
By means of the writ petition, the petitioner has come to this Court seeking a direction to remove the container of garbage in front of his house. The garbage strewn in the container often gets dispersed and is strewn all around the place. Learned counsel for the petitioner also prays that the same may also be removed and the area be cleaned.
Sri Vivek Verma, learned counsel for the respondent No.4- Nagar Nigam, Kanpur submits that the garbage has now been removed and area has been cleaned and he further assures the Court that the garbage will be lifted and the area will be cleaned periodically to avoid spread of any disease.
That being the case, no cause of action now survives. The writ petition is dismissed.
