This Court has noticed the averments made in the affidavit-in-reply, filed on 24-8-2011, on behalf of the Deputy Municipal Commissioner, Vadodara Municipal Corporation. On perusal thereof, it is clear that respondent Corporation is aware that there is an encroachment on some portion of the Final Plot No.85. However, the said affidavit-in-reply does not disclose what action is being taken by the Corporation to remove the encroachment.
Mr.Nilesh A.Pandya, learned advocate for Vadodara Municipal Corporation, states that the Court shall be apprised of the procedure that may be followed by the respondent Corporation, by the next date of hearing.
