Upendra vs State

High Court Of Gujarat|29 February, 2012

JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) By way of this application, the applicant-convict has prayed that he be enlarged on temporary bail on the ground that he wants to attend the marriage of his brother which is scheduled on 6th March, 2012.
Pursuant to the earlier order passed by this Court, on 24th February, 2012, learned APP based on the report received from Police Superintendent of Narmada, has stated that the ceremony is fixed for the marriage.
Further from the jail report, it appears that whenever the applicant was enlarged on temporary bail or on furlough leave, he has surrendered to the jail authority in time.
Considering the totality of the facts, it is ordered that the applicant-convict be enlarged on temporary bail from 3.3.2012 to 11.3.2012 on personal bond of Rs.5,000/- with one surety of like amount and with the further direction that he shall surrender with the jail authority on 12th March, 2012.
Application allowed to the aforesaid extent. Rule made absolute.
