Heard learned counsel for the petitioner and Shri Ram Babu Yadav for the Bhoom Prabandhak Samiti, respondent no.30 as also learned Standing Counsel for the State-respondent.
The writ petition has been filed seeking the following relief -
"(a) issue a writ, order or direction in the nature of mandamus commanding the issue a direction to issue a direction to the Commissioner Vindhyachal Division, Mirzapur to dispose of the Stay application dated 22.02.2019 filed by petitioner in Appeal No.123 of 2019 on the any date fixed any further be pleased to direct the said commissioner to decide the aforesaid appeal No.123 of 2019, thereafter within a short period as fixed by this Hon'ble Court, if possible within a period of two months and further be pleased to grant the interim order directing the parties of the appeal No.123 of 2019 to maintain status quo over the plot in the dispute till the disposal of interim application dated 22.02.2019 pending in appeal no.123 of 2019 before the court of Commissioner Vindhyachal Divisional otherwise petitioner will suffer irreparable loss and injury."
Perusal of the order sheet appended to the writ petition reveals that the appeal itself is pending consideration at the stage of admission.
The writ petition is disposed of directing the Commissioner Vindhyachal Division, Mirzapur to endeavour to consider the appeal on the question of admission as expeditiously as possible and preferably within a period of one month from the date, a certified copy of this order is filed before him.
