Learned counsel for the petitioners has placed his reliance to the order dated 10.07.2014 passed in Writ C No. 43811 of 2013 (Managing Director U.P. State Ware Housing Corporation & Ano. Vs. Presiding Officer, And Another). Same is reproduced herein bellow:-
"Sri Yogesh Srivastava who appears for the contesting respondent workman prays for and is granted one month time to file counter affidavit.
List this matter on 13.8.2014.
Subject to payment of month to month wages to the respondent workman, the impugned award shall be kept in abeyance till 13.8.2014. The back wages shall also be kept in abeyance. It is made clear that month to month wages will be paid to the respondent workman within two weeks from today. It is also made clear that failure to comply with the order will render the stay order automatically vacated."
Learned counsel for the petitioners submits that same order may also be passed in the present writ petition.
Learned counsel for the respondents prays for and is granted a weeks time to file counter affidavit. The petitioners will have one week thereafter to file rejoinder affidavit.
List this matter after two weeks.
Subject to payment of month to month wages to the respondent workman, the impugned award shall be kept in abeyance till the next date of listing. The back wages shall also be kept in abeyance. It is made clear that month to month wages will be paid to the respondent workman within two weeks from today. It is also made clear that failure to comply with the order will render the stay order automatically vacated.
