Since the entire awarded amount has already been deposited by the appellant as per certificate of deposit annexed with the Supplementary Affidavit filed in this case, therefore the appeal will be heard and the stay of the order impugned dated 5.9.2009 passed by the Workmen Compensation Commissioner/Assistant Labour Commissioner, Varanasi in Case No. W.C. No.03 of 2008 will be operative.
The Commissioner concerned is at liberty to release 50% of the principle sum to the claimants without security and the balance amount will be kept in a short term Fixed Deposit of a Nationalised Bank and will be renewed time to time till the payment is made or till further order/s of this Court, which ever is applicable.
