In pursuance of the order dated 23.3.2012, Nagar Ayukt Allahabad as well as Zonal Adhikari, Zone No. 3 are present in the Court.
Sri S.D. Kautilya, learned counsel for the Nagar Nigam has submitted that the District Magistrate has already issued an order on 14th March, 2012 that certificate must be obtained from the Nagar Nigam to the effect that all concerned persons were given opportunity before recovery certificate has been issued and only then recovery be ensured. It is further submitted that Nagar Ayukt has constituted a committee by order dated 17th March, 2012 in view of the letter of District Magistrate, Allahabad dated 14th March, 2012 to reconsider. He further submits that Nagar Nigam does not propose to carry on the recovery proceedings and the matter needs to be considered afresh.
Shri S.D. Kautilya, learned counsel for the Nagar Nigam seeks time to file affidavit in that regard.
Put up day after tomorrow as fresh.
Nagar Ayukt, Allahabad may file appropriate affidavit by the next date.
