Counter and rejoinder affidavits filed by the respective parties are admitted to record.
Heard Mr. S.K.Kalia, Senior Advocate assisted by Mr.Upendra Singh, learned counsel for the petitioner, but his arguments could not be concluded.
It has been urged on behalf of learned counsel for the petitioner that in criminal proceedings, which has been initiated and are pending for adjudication before the Tribunal, the date has been fixed for tomorrow i.e. 13.03.2012 to which learned counsel for the opposite parties Ms. Renu Mishra states that she will seek adjournment for tomorrow and will not press the proceedings so initiated before the Tribunal.
Accordingly, it is provided that in case any application for adjournment is moved before the Tribunal, as has been undertaken before this Court,the Tribunal shall postpone the hearing of the matter tomorrow and slate it for hearing in the last week of March, 2012. It is further provided that appearance of the officers of the U.P. Power Corporation fixed for tomorrow is exempted.
Put up this case tomorrow i.e. 12.03.2012 for hearing at 2.00 p.m. along with Writ Petition No.1597 (S/B) of 2008.
