JUDGMENT / ORDER

The petitioner is the accused in Crime No.365/2014 of Shornur Police Station, Palakkad District. Crime was registered under section 376 of IPC against the petitioner based on the complaint filed by the complainant on an earlier occasion.
2. The defacto complainant is the 2nd respondent, who is represented by her counsel. It is pointed out that even before the accused was arrested their marriage had already taken place. But only because crime was registered under section 376 of IPC, he was arrested by the Police. Subsequently, taking note of that fact, this Court granted bail to the petitioner/husband. This petition is to quash the proceedings in view of the fact that the petitioner and complainant are staying together as husband and wife.

Photographs, marriage certificate and so many documents have been shown to me to convince that fact. Since both of them are staying together happily as husband and wife, it is just and proper that further proceedings in the above crime is quashed.
3. Hence, further proceedings in Crime No.365/2014 of Shornur Police Station, Palakkad District, shall stand quashed.
