(Per : HONOURABLE MR.JUSTICE V. M. SAHAI) We have heard learned advocate Mr.H.D.Dave for the petitioner and learned advocate Mr.Y.H.Motiramani for the respondent No.1.

The petitioner can avail alternative remedy of filing appeal under Section 20 of The Recovery of Debts Due to Banks and Financial Institutions Act, 1993, before the appellate tribunal. Therefore, this Special Civil Application is dismissed on the ground of alternative remedy available to the petitioner to file appeal under Section 20 of the said Act.
