It is not in dispute that in spite of registration of offences under Sections 365, 341 and 114 of the IPC and under section 3[i] & [x] of The Scheduled Castes and The Scheduled Tribes [Prevention of Atrocities] Act, 1989 and though the accused are available, the Investigating Officer has not yet arrested them. From the investigation, prima facie, it appears that the Investigating Officer is in collusion with the accused persons and thereby he is protecting and shielding the accused persons.
In view of the above, if the accused are not arrested, the District Superintendent of Police, Junagadh is directed to remain personally present before the Court on the next date of hearing.
Post the matter on 4th May, 2012.
