Learned advocate for respondent No.1 requests to stay the order dated 13.8.2012 which is opposed by learned advocate for Union of India/Western Railway and admittedly as per the case of the western railway period of license is already over and the respondent is in unauthorized occupation of license premises.

In view of the above, the request of learned advocate for respondent No.1 is rejected and orders impugned dated 2 nd December, 2011 passed by learned Principle Senior Civil Judge in application Exh.45 in Special Civil Suit No.39 of 2005 is stayed till further order.

Direct service is permitted.
