Heard learned advocates for the petitioner as well as respondent No.2.
2. As per the affidavit of service, order dated 28.08.2012 passed by this Court is served upon the respondent No.1 University.
3. In callous disregard to order dated 28.08.2012 and earlier orders passed by this Court, today no one has remained present in the Court. Even, Shri Y.C.Contractor, learned advocate appeared earlier for the respondent No.1 University is also not present.
4. The above act of officers viz. Controller of Examinations SCA/8134/2012 2/2 ORDER and Registrar of the respondent No.1 University prima facie amounts to willful disobedience and disregard to the orders passed by this Court and have exposed themselves to the proceedings of Contempt of Courts Act, 1971 and Rules made thereunder.
5. In spite of opportunity given by an order dated 28.08.2012, no representation is made today. Therefore, this Court is left with no alternative but to initiate proceedings under the Contempt of Courts Act, 1971 against the Controller of Examinations and Registrar of respondent No.1 University as well as against Shri Y.C.Contractor, learned advocate, who earlier appeared for the respondent-University.
Post the matter on 10th September, 2012.
