In addition to what is recorded in order dated 08.02.2012, it is not in dispute that these petitions are filed under Articles 226 & 227 of the Constitution of India against the order of Gujarat Civil Services Tribunal whereby the order of punishment of removal of appellants dated 09.07.2008 is quashed and punishment and removal from service awarded to appellants is substituted by withholding 5 increments with future effect and the appellants are ordered to be reinstated in service.
While passing the above order, the Tribunal has considered material on record, including report of the Inquiry Officer, order passed by the Disciplinary Authority, nature of HC-NIC Page 1 of 2 Created On Sat Aug 12 09:30:45 IST 2017 SCA/1108/2012 2/2 ORDER misconduct, order imposing penalty of removal, reducing the above penalty, etc. In the above backdrop of factual aspects, learned AGP seeks time.
Post the matters for final disposal on 4th September, 2012.
