Learned advocate for the petitioner has placed reliance on decision of this court in the case of Zonal Manager v. Akhilbhai B. Mehta [2002 (2) GCD (UJ) 71] about claim of amount of interest in absence of any contract and maintainability of the summary suit and availability of remedy under Articles 226 and 227 of the Constitution of India by filing writ petition when trial Court passes composite order namely, refusing leave to defend and also a decree in the case of Centurion Bank Limited v. Larsen and Tourbro Limited and Anr. [2004 (3) GH 773] and it is submitted that the order impugned is contrary to law laid down as above.
