A.D. Mithani learned counsel appearing on behalf of the original claimants has placed on record the communication dated 17.01.2012 of the original claimants wherein, it has been stated that a consensus has been arrived at between the parties whereby, the appellant-Insurance Company shall make payment of Rs.2.05,000/- to the original claimants along with interest at the rate awarded by the Tribunal and such payment shall be considered as full and final settlement of the impugned award.

In view of the settlement arrived at between the parties, it is directed that the impugned award passed by the Tribunal is substituted in the manner that the appellant-Insurance Company shall make payment of Rs.2,05,000/- [Rupees Two lacs five thousand only] along with interest at the rate of 12% per annum from the date of claim petition filed before the Tribunal and till the payment is made.
3. Accordingly, the impugned award stands substituted by the aforesaid order. The claim petition u/s.166 of the M.V. Act pending before the concerned Tribunal shall stand disposed of in view of the above order. The communication dated 17.01.2012 is taken on record. The appeal stands disposed of accordingly.
