By way of this Appeal, the appellant has challenged the judgment and order dated 17.4.2000 passed by the learned Single Judge in Special Civil Application No. 6361 of 1999, whereby the learned Single Judge has dismissed the petition of the appellant-petitioner and has confirmed the order dated 30.6.1999 passed by the Payment of Wages Authority, Vadodara in Application No. 425 of 1990, whereby the Payment of Wages Authority has allowed the application preferred by the respondent no.1.
2. The case of the petitioner is that the Payment of Wages Authority, Vadodara as well as the learned Single Judge has committed an error and entertained the application after 12 months. In view of statutory provisions of Section 15(2) of Payment of Wages Act, 1972, the application is not maintainable and therefore, the Authority should not have allowed the application of the respondent no.1. However, learned counsel for the appellant has fairly conceded that this Court, while admitting the Appeal on 22.9.2011 has passed the following order:

2. Learned Single Judge,while considering the case of the petitioner, has exhaustively considered all the contentions raised by the petitioner. We are in complete agreement with the view taken by the learned Single Judge. However, looking to the small amount of Rs. 41,850/-, we are not discussing in detail the judgment of the learned Single Judge. This Appeal is devoid of merits. It is accordingly dismissed. However, this will not be teated as precedent against the appellant.
