Shah, learned counsel for the respondents has raised a preliminary objection that an application u/s. 170 of the Motor Vehicles Act has been filed by the appellant Insurance Company and, therefore, these appeals are not maintainable. However, Mr. Nanavati, learned counsel for the appellant is not in a position to dispute this proposition. Hence, on this ground alone, the appeals are dismissed.
