JUDGMENT / ORDER

The issue involved in the present appeals are squarely covered by the decision of the Apex Court in the case of National Insurance Company Ltd. Vs. Sinitha and Others, reported in 2011(13) SCALE 84 (= 2012(2) SCC 356). Mr. Nanavati has also relied upon another decision of the Apex Court reported in 2008(1) SCC 423. However, Mr. Pandya requests for time to go through the aforesaid decisions. List on 01.03.2012.
