ORDER IN FIRST APPEAL;
Having considered the submissions advanced by learned advocate for the appellant-Insurance Company so also considering the impugned judgment and award dated 26.07.2012 rendered by the Tribunal, it appears that the appeal deserves consideration and hence, Admitted.
ORDER IN CIVIL APPLICATION:
Having considered the submissions advanced by learned advocate for the applicant-Insurance Company so also considering the impugned judgment and award dated 26.07.2012 rendered by the Tribunal, Rule returnable on 29 th January, 2013.
Learned Advocate Mr. Vibhuti Nanavati for the applicant-appellant states that the Tribunal has awarded compensation in the sum of Rs. 4,10,000/-. The applicant-appellant herein is admitting its liability to the extent of Rs.2,33,400/- and the present First Appeal has been filed challenging the award in the sum of Rs.1,76,600/-.The same is also reflected in ground (I) of the Appeal Memo.
Considering the said fact, there shall be ad-interim stay in terms of para-6(A) on the condition that on or before returnable date, the applicant Insurance Company shall deposit the entire awarded amount together with interest and proportionate costs with the concerned claim Tribunal.
