Heard Sri Saurabh Srivastava, learned counsel for the appellant.
Stamp reporter has reported that the instant appeal is filed beyond time by 495 days.
Learned counsel for the appellant has pointed out that a division bench of this Court has admitted the appeal being F.A.F.O. (D) No. 1207 of 2017, which also arises out of the same accident in which the husband of the claimant died.
This appeal is filed against the judgment and award dated 5.1.2017 by which the Tribunal has awarded a sum of Rs.75000/- only as against the claim amount Rs.18,09,000/-.
I have perused the delay condonation application as well as the impugned order of the Tribunal. In my opinion, the explanation offered in the delay condonation application is not acceptable. Even otherwise also there is no merit in the appeal.
The appeal is accordingly, dismissed.
The appellant is directed to pay the entire amount to the claimant Smt. Reena Singh within a period of one month.
Any amount deposited in this Court shall be remitted to the concerned Tribunal within two weeks and the same shall be duly accounted for/adjusted while making the aforesaid payment.
