Learned counsel for the appellant submitted that the appellant is an insurer of Motorcycle, bearing registration no. U.P. 93AA-7313, which is said to have been involved in the accident. At the time of accident, three persons were sitting on the said Motorcycle which was a breach of the condition of the policy and, therefore, the appellant is not liable to indemnify the liability of the owner of the vehicle.
Admit.
Issue notice. The appellant may take steps to serve the respondents by registered post.
The appellant is directed to deposit the entire amount of award within a period of two months. Any amount already deposited shall be given adjustment. Out of the amount deposited, the claimant shall be entitled to withdraw the entire amount as per the direction given by the Tribunal.
Office is directed to remit back the statutory amount to the concerned Tribunal within a period of four weeks.
